Le stalking (de l'anglais to stalk : « traquer ») est une forme de harcèlement.
Celui qui exerce ce harcèlement est un stalker. Il suit avec une attention maladive les faits et gestes d'une personne, en général une célébrité.
Dans certains États américains, il existe des lois contre le stalking, comme depuis 1990 en Californie.
D’après la définition du clinicien américain John Reid Meloy, trois élèments permettent de définir le stalking[1] :
- Intrusion vis à vis d’autrui contre sa volonté
- Menace implicite ou explicite manifestée dans le comportement de l’agresseur
- Dont la conséquence est un sentiment de peur chez la victime
Le Code Pénal de Californie (en) défini le stalking[2] : « Any person who willfully, maliciously, and repeatedly follows or willfully and maliciously harasses another person and who makes a credible threat with the intent to place that person in reasonable fear for his or her safety, or the safety of his or her immediate family is guilty of the crime of stalking. »
