Un Contingency est une pratique commerciale de recrutement signifiant que d'une part le paiement des honoraires est conditionné par l'embauche effective de l'un des candidats présentés (pas de paiements d'acomptes) et que d'autre part, la recherche n'est pas exclusive (inexistence d'un contrat d'exclusivité signé avec un cabinet de recrutement) et donc que plusieurs cabinets sont en général missionnés et mis en concurrence sur un même poste à pourvoir.
"Que le plus rapide gagne" pourrait être la devise du Contingency.
Cette pratique qui se veut constituer une obligation de résultats, possède le double inconvénient de s'opposer au principe fondateur de l'obligation de moyens du cabinet (en anglais Retainer) et de bafouer les règles les plus élémentaires de déontologie et de confidentialité, inhérentes à la profession.
Le contingency est réprouvé et combattu avec vigueur par le syndicat Syntec, de par les nombreuses dérives intrinsèques qu'il met en œuvre.
