Le mujtahid ou moujtahid (مُجْتَهِد [mujtahid]) est celui qui prononce une interprétation personnelle (ijtihâd) sur un point de droit dans l'islam. L'ijtihâd est le jugement résultant de la réflexion du mujtahid.
- al-mujtahid al-mutlaq : capable de faire se rapprocher des textes divergents et en tirer la synthèse, élaborer les principes juridiques sans référence à une école particulière (madhhab). Ces compétences sont considérées comme exceptionnelles et rarissimes.
- al-mujtahid al-mutlaq al-muntasib le même mais dans le cadre d'une école interprétative (madhhab).
- al-mujtahid fil-madh'hab dans le cadre d'une école interprétative, capable d'élaborer des réponses juridiques sur des questions nouvelles.
Remarque
Les correcteurs othographiques considèrent le mot mujtahid comme une faute, comme si l'on faisait une confusion avec mujâhid.
Les deux mots sont issus de la même racine JaHaDa ( جَهَدَ [jahada], faire un effort) qui dans ses dérivés donne JâHaDa (جاهَدَ [jāhada], lutter) puis jihâd et mujâhid ou dans un sens plus abstrait ijtihâd et mujtahid.
