Outre la situation d’une jeune personne, appelée « aide familial étranger » qui travaille à l’étranger chez une famille d’accueil, situation détaillée dans l’article « Séjour au pair », le terme au pair désigne un statut légal en France situé entre le statut de salarié et celui de bénévole.
Légalement, une personne ne percevant pas de rémunération pour son travail mais des avantages en nature (hébergement et/ou repas) est « au pair » ; la rémunération étant réservée au salarié et les avantages en nature étant interdits au bénévole (toutefois un remboursement de frais n’est pas comptabilisé comme avantage en nature). Sont exclus du statut d’au pair les membres d’une famille rendant service (même continuellement) et bénéficiant en même temps de l’obligation alimentaire assumée, de fait et de droit, par le ou les responsables légaux de la famille.
Dans le langage courant, le terme « bénévole » pour une personne au pair est souvent utilisée.
Le statut de personne au pair est utilisé entre autres pour des animateurs sur des séjours collectifs de centres de vacances d’association.
